Appeal Acquittal in Military Indecent Assault Case: First-Trial Conviction Reversed Through Credibility Impeachment

Background / Issue
The client, an active-duty military member, encountered a subordinate (the complainant) by chance in the lobby of an officetel in Gyeonggi Province in October. The prosecution alleged that the client told the complainant 'I love you,' placed both hands under the complainant's armpits and hugged once (indecent assault), and subsequently kicked the complainant's buttocks (assault). At the first trial, the court found the client guilty based on the complainant's consistent statements and messages sent to friends after the alleged incident, imposing a fine of 3 million KRW for indecent assault and 500,000 KRW for assault. The case presented a critical challenge: apart from the complainant's testimony, there was no objective evidence such as CCTV footage. The first trial court accepted the complainant's statements and the testimony of closely related individuals without meaningful scrutiny.

During the first trial, detailed witness examinations were conducted regarding individuals present at the scene and surrounding persons. The defense highlighted potential motives for a false accusation, including the complainant's mention of settlement money before filing the report and circumstances suggesting an attempt to secure a permanent transfer within the unit. Rather than merely criticizing the complainant's post-incident conduct, the defense presented a legal argument demonstrating that it was difficult to reconcile the complainant's behavior — exchanging affectionate messages with the client, giving the client gifts, and sharing meals and drinks together after the alleged incident — with the conduct expected of someone who had experienced a severe indecent assault of the level charged. The team also emphasized the physical implausibility of the alleged bold indecent assault given the location, an open officetel lobby where fellow soldiers could pass by at any time. On this basis, Taeshin Law Firm prepared and submitted a detailed appeal brief and defense opinion demonstrating that the first trial contained serious errors of fact and law.
Result / Outcome
The appeal court reversed the first-trial conviction on the indecent assault charge and acquitted the client. The assault charge was upheld. This case reaffirms the fundamental principle that in sex crime cases where the complainant's testimony is the sole evidence, the court must strictly examine whether that testimony has the credibility to exclude reasonable doubt.
