No-Charge Decision for Foreign Client in Quasi-Rape Case Involving Hotel Stay

August 2026

A foreign national residing in Korea was accused of quasi-rape after a hotel stay with a woman he had met through social media. The complainant alleged that the client touched her while she was sleeping and committed an indecent act. The client maintained that any physical contact was consensual and that the accusation arose after he refused a sudden demand for money. Taeshin Law Firm assigned an English-speaking attorney, analyzed social media content from both parties, and demonstrated that the complainant's account was inconsistent with the surrounding circumstances. The police issued a no-charge decision for insufficient evidence.

Background / Issue

The client was a foreign national residing in Korea who enjoyed posting travel videos and photographs on social media. He met the complainant through a social media platform and agreed to travel together in the Gangnam area of Seoul. During the trip, they stayed at a hotel together. On the day of the alleged incident, the client had a separate solo travel schedule and returned to the hotel room afterward. The complainant was sleeping when he returned. She later accused him of touching her chest and inserting his fingers into her genital area while she was asleep, and reported the matter to the police as a quasi-rape allegation. The client maintained his innocence, explaining that after returning to the room they had discussed their travel experiences, changed clothes, and engaged in consensual physical contact. He denied any non-consensual act and stated that the complainant had caused a disturbance for more than an hour on a live social media broadcast after he refused her unexpected demand for money, and that she subsequently reported the false allegation to the police.

Our Legal Approach

Taeshin Law Firm recognized that the client's limited Korean language ability required effective communication from the outset. The team assigned an English-speaking defense attorney with extensive sex crime case experience to ensure that the client could explain the circumstances fully and accurately. The defense team worked closely with the client to understand the detailed factual background and simultaneously collected and analyzed social media posts published by both the client and the complainant after the alleged incident. Through this analysis, the team identified evidence that the complainant had not been in a state of unconsciousness at the relevant time, that the two had continued to stay together at the hotel and travel around Seoul on the following day, and that videos posted on their respective social media accounts showed mutually consensual physical interaction. The defense submitted a detailed legal opinion to the investigative authorities arguing that it was impossible to conclude that the client possessed the criminal intent required for quasi-rape, and that the complainant's account was contradicted by objective digital evidence.

Result / Outcome

The police issued a no-charge decision, finding that the evidence was insufficient to support the quasi-rape allegation. The client was not forwarded to the prosecution and avoided indictment entirely. This outcome was significant because quasi-rape is punishable by at least two years of imprisonment under Korean law, with no possibility of a fine, meaning that a conviction would have resulted in immediate incarceration. The client was able to clear the false accusation and avoid both a criminal record and detention.
